1. Agreement to Terms

By accessing our website(s), submitting forms, scheduling services, or otherwise engaging with Carolina Foundation Solutions and its affiliated companies under Vanterra Foundation Solutions (“Company,” “we,” “our”), you agree to these Terms & Conditions (“Terms”). If you disagree, do not use our services or website.

  • Service requests and scheduling
  • Communications with us
  • Any services we provide

2. Eligibility

You must be at least 18 years old and have legal capacity to enter contracts. By using our services, you represent that you meet these requirements.

3.1 Service Scope

We provide foundation repair, basement waterproofing, crawl space repair, concrete lifting, and related services. All services are subject to:

  • Site inspection and feasibility assessment
  • Geographic service area availability
  • Execution of a written Service Agreement
  • Local permits and regulations

3.2 Estimates & Pricing

Website descriptions and estimates are informational only and non-binding until formalized in a Service Agreement. Final pricing depends on actual site conditions.

3.3 Service Agreements

Specific work is governed by the written Service Agreement you sign. If conflicts arise between these Terms and your Service Agreement, the Service Agreement controls.

4. Affiliate Routing

If your location falls outside our primary service area, we may share your information with an affiliated Vanterra Foundation Solutions company to fulfill your request. This is for operational purposes only, not third-party marketing.

5. Communications & Consent

5.1 Electronic Communications

By providing contact information, you consent to receive communications about:

  • Service scheduling and updates
  • Appointment confirmations
  • Follow-up communications
  • Promotional offers (with opt-in consent)

5.2 SMS/Text Terms

  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to opt out
  • Reply HELP for assistance
  • Consent not required for purchase

5.3 Call Recording

Calls may be recorded for quality assurance and training. By calling or accepting our calls, you consent to recording.

5.4 On-Site Documentation

Technicians may photograph or record service visits for documentation, training, or warranty purposes. Separate consent required for marketing use.

6. Intellectual Property

All website content, logos, trademarks, and materials are owned by or licensed to Company and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content
  • Use our trademarks without permission
  • Scrape or automatically collect website data
  • Create derivative works

7. User Conduct

You agree not to:

  • Submit false or misleading information

THE WEBSITE AND INFORMATION ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

WE DO NOT GUARANTEE:

  • Uninterrupted website access
  • Error-free operation
  • Accuracy of all information
  • Freedom from viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE AT ISSUE IN THE 12 MONTHS PRECEDING THE CLAIM.

These limitations apply regardless of legal theory and even if we knew of potential damages.

You agree to defend, indemnify, and hold harmless Company, its affiliates, and their respective officers, directors, employees, and agents from claims arising from:

  • Your breach of these Terms

  • Your violation of laws or third-party rights

12. Termination

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Any reason at our discretion

Upon termination, your right to use our services ceases immediately.

If any provision is deemed invalid, the remaining Terms continue in full effect.

These Terms, the Privacy Policy, and any Service Agreement constitute the complete agreement between us, superseding prior understandings.
